2. Customers

The Professional plan is reserved for businesses acting for the purposes of their trade: by subscribing to it, you declare that you are acting for business purposes. It is open to businesses established in France (verified SIREN number) and in other European Union countries (EU VAT number). Businesses established elsewhere, including the United Kingdom and Switzerland, can contract the Enterprise plan on quote.

The Individual plan is for consumers, meaning natural persons acting outside any business activity, resident in France or in another European Union country. The provisions specific to consumers are set out in section 14; they prevail over anything to the contrary in these terms of sale.

For the Professional and Enterprise plans, concluded between businesses, the withdrawal right that applies to consumers does not apply.

3. Plans and prices

  • Découverte

Free. One seat (the organization's owner), 2 viewers, 1 active project, 2 versions per project, 2 regulatory analyses per 30-day period, 20 AI assistant messages per day, watermarked reports, no 3D or 2D export.

  • Individual

€59 per month billed monthly, or €49 per month billed yearly (€588 per year, paid in advance), all taxes included. One user, with no collaborators or viewers. Unlimited projects, 10 versions per project, 15 regulatory analyses per month, 300 AI assistant messages per day, reports with your letterhead, IFC and 3DS 3D exports and DWG and DXF 2D plans.

  • Professional

€59 per seat per month billed monthly, or €49 per seat per month billed yearly (€588 per seat per year, paid in advance). Unlimited projects, 10 versions per project, 15 regulatory analyses per seat per month shared across the organization, 300 AI assistant messages per day per user, 10 free viewers, reports with the organization's letterhead, IFC and 3DS 3D exports and DWG and DXF 2D plans.

  • Enterprise

On quote, from 10 seats, paid by invoice. The specific terms of the quote take precedence over these terms of sale.

Up-to-date limits for each plan are listed on the billing help page. VAT not applicable, Article 293 B of the French Tax Code (CGI): the prices shown are the prices to pay, with no VAT added, and your invoices carry this statement.

The publisher's VAT status (small-business exemption, Article 293 B of the French Tax Code): to be confirmed with the accountant before publication.

A price change does not apply to existing subscriptions: your subscription keeps the price in force when you subscribed. Any change would be notified at least 30 days in advance.

4. First month free

The first month of the monthly Professional subscription is free, once per email address and per organization. A payment card is required when you subscribe, and the first charge happens at the end of the free month. During that month the organization gets the full Professional plan, with its usual limits. The offer does not apply to the annual subscription.

An organization whose former 14-day no-card trial is still running keeps it until it ends; if it subscribes during that trial, the first charge happens when the trial ends. Without a subscription, the organization moves to the Découverte plan at the end of the trial, at no cost.

5. Seats

The Professional plan is billed per seat. An organization's owners, admins and members each take a paid seat; viewers are free, within the plan's limit. A pending invitation is only billed once accepted.

  • A seat added during a period is charged immediately, pro rata for the remaining period.
  • A removed seat stays paid until the end of the current period, with no refund or credit. It can be reassigned at no charge during that period.
  • On yearly billing, the period is the year: a removed seat can therefore stay paid for up to 11 months.
  • Above 50 seats, the Enterprise plan applies.

6. Subscription, payment and invoices

Subscriptions are taken out from the organization's Billing page, by its owner, after the business has been verified. Payment is made by card through our payment provider Stripe; Rotarchi never has access to your card details.

The subscription is paid in advance and renews automatically at the end of each period (month or year) for the same duration, until it is cancelled. Invoices are issued with each payment and are available in the payment portal, reached from the Billing page.

7. Failed payment

If a renewal fails, the payment is retried and you have 14 days to update your payment method, with no interruption of service. After that, the organization moves to the Découverte plan until the overdue invoice is paid. If the retries remain unsuccessful, the subscription is cancelled.

Mandatory business-to-business statements (late-payment penalties, fixed recovery fee) under the law applicable to the seller: to be completed by a legal professional.

8. Cancellation

You can cancel the subscription at any time from the Billing page. Cancellation takes effect at the end of the current period: access stays open until then, and the subscription can be resumed until that date.

No refund is due on cancellation, yearly subscriptions included. Switching from yearly to monthly billing takes effect at the end of the current year.

The publisher may terminate the subscription for a serious breach of the terms of use or of these terms of sale, after formal notice has gone unanswered, or immediately in case of fraud.

9. Back to Découverte

At the end of the trial, of the subscription, or of the 14 days following a failed payment, the organization moves to the Découverte plan. Its data is kept: nothing is deleted.

  • Only the owner can then edit projects, and only while the organization has at most one active project: they can archive projects, or subscribe again.
  • Versions beyond 2 stay readable; new reports carry a watermark. Reports already generated keep their presentation.
  • A project report generated on demand follows the plan in force when it is generated.
  • Everything comes back as it was as soon as you subscribe again.

10. Liability and service

The conditions of service, the indicative nature of results (in particular regulatory analyses produced with artificial intelligence) and the publisher's limits of liability are those of the terms of use.

11. Personal data

Billing data and its processing by Stripe are described in the privacy policy.

12. Changes to these terms

The publisher may change these terms of sale. New terms are notified to you by email at least 30 days before they take effect, and apply from the next renewal. If you do not accept them, you can cancel the subscription before that date.

13. Governing law and disputes

These terms are written in French, and the French version prevails over any translation. They are governed by French law. In case of dispute, first contact the publisher to seek an amicable solution. If no agreement is reached within thirty days, the dispute falls under the courts with jurisdiction over the seller's registered office, subject to mandatory rules of jurisdiction.

Governing law (French law) and competent court given where the seller is established: to be confirmed by a legal professional.

14. Individual customers (Individual plan)

This section applies to customers who subscribe to the Individual plan as consumers.

Right of withdrawal. You have 14 days from the date you subscribe to withdraw, without giving any reason and without bearing costs other than those set out below (Articles L221-18 et seq. of the French Consumer Code).

  • To exercise it, use the “Withdraw” button on the Billing page, or send us an unambiguous statement before the period ends (for example by email to the contact address given in section 1).
  • Model withdrawal form: “To [publisher, address, email]: I hereby give notice that I withdraw from my contract for the Rotarchi Individual subscription, subscribed on [date], in the name of [name], at [address], on [date].”
  • The service only starts during the withdrawal period at your express request, collected when you subscribe. If you withdraw after making that request, you pay an amount proportionate to the service provided until you communicated your decision (Article L221-25).
  • Any amount still owed to you is refunded within 14 days of your decision, using the payment method used when you subscribed, at no cost.
  • Withdrawal stops the subscription immediately: the organization returns to the Découverte plan, without losing any data.

Renewal. The yearly subscription renews automatically. In accordance with Article L215-1 of the French Consumer Code, you are informed by email, no earlier than three months and no later than one month before the end of the term, that you may choose not to renew it. You can cancel the subscription, monthly or yearly, at any time from the Billing page in a few clicks: cancellation takes effect at the end of the current period.

Prices. Individual plan prices include all taxes; VAT not applicable, Article 293 B of the French Tax Code (CGI).

Mediation. If a dispute arises, first send a written complaint to the publisher. If no amicable solution is found, you can refer the dispute free of charge to the following consumer mediator (Articles L612-1 et seq. of the French Consumer Code):

Consumer mediator
CM2C L612-1

You can also use the European online dispute resolution platform. By way of derogation from section 13, you may bring proceedings, at your choice, before the court of the place where you lived when the contract was concluded or when the harmful event occurred (Article R631-3 of the French Consumer Code), and you keep the protection granted to you by the mandatory provisions of the law of your country of residence.

Consumer clauses (withdrawal, renewal, mediation, jurisdiction): to be reviewed by a legal professional before the Individual plan opens.
