These terms of service (the "Terms") govern access to and use of Rotarchi. Please read them carefully: they apply as soon as you create your account.
1. Purpose and acceptance
Rotarchi is an online real estate feasibility platform: parcel search, analysis of applicable planning rules, programming, 3D massing simulation, comparison of versions and report generation.
You accept the Terms by ticking the box provided when you create your account, when you first sign in with Google or Microsoft, or when a new version is presented to you. The accepted version and its date are recorded and can be viewed in Account > Data.
2. Definitions
"Publisher"
The operator of Rotarchi, identified in the legal notice.
"Service"
The Rotarchi platform and all its features.
"User", "you"
Any person with a Rotarchi account.
"Organisation"
A workspace: your personal workspace, or a workspace shared with other users by invitation.
"Project"
A feasibility study created in an organisation: parcels, programme, constraints, versions and reports.
"Content"
The information you enter in or send to the Service.
"Results"
The analyses, planning rule extractions, massing, assistant answers and reports produced by the Service, including with artificial intelligence.
3. Access to the Service
The Service is open to professionals (architects, developers, engineering firms, companies…) and to individuals. You must be an adult with the legal capacity to enter into a contract; if you act on behalf of a company or organisation, you must be authorised to bind it.
Any paid plans are reserved for professionals and governed by separate terms of sale (see section 10).
4. Account and security
An account is created with an email address and password, or with a Google or Microsoft account. You agree to provide accurate information and keep it up to date.
You are responsible for keeping your credentials confidential and for the activity carried out from your account. Two-factor authentication is available and recommended. Notify the publisher without delay if you suspect unauthorised use.
5. Organisations and collaboration
- Each account has a personal workspace. You can create a shared organisation or join one by invitation.
- Roles (owner, administrator, member, viewer) determine each person's rights; a viewer can consult but not edit.
- Projects created in a shared organisation belong to that organisation: they stay there if you leave it or delete your account.
- Members of an organisation see the other members' name, email address, picture, occupation and role.
- By inviting someone, you confirm that you have a legitimate reason to send this invitation to the address given.
- The owner of a shared organisation must transfer ownership before being able to delete their account.
6. Acceptable use
By using Rotarchi, you agree not to:
- use the Service for illegal purposes or in breach of these Terms;
- attempt to bypass security measures, quotas or usage limits, or to access data not intended for you;
- query the Service in an automated or excessive way, in particular with regard to the public services it queries on your behalf (IGN, Géoportail de l'urbanisme, Géorisques);
- use the assistant to produce unlawful, misleading or harmful content;
- enter third parties' personal data without being entitled to do so;
- share your credentials with an unauthorised person;
- decompile, disassemble or reverse-engineer the Service, except where permitted by law.
7. Your content and the results
You retain ownership of your Content. You grant the publisher, for the time needed to provide the Service, a non-exclusive, royalty-free licence to host, reproduce, process and display this Content, solely to operate the Service, including its transmission to the technical providers described in the Privacy Policy (in particular the provider of the language models).
You warrant that you hold the necessary rights to the Content you enter. The publisher claims no rights to your Content; you may use the Results produced for your own needs, subject to third-party rights, in particular the licences of public data and base maps.
8. Artificial intelligence and limits of the results
Some features (assistant, planning rule extraction, summaries) rely on language models provided by a third party.
- Results are produced automatically from your input and public sources: they may be incomplete, inaccurate or outdated, in particular if a source itself is.
- They are neither legal advice, nor a planning permission or decision, nor a study carried out by a professional.
- They must be checked by a competent person against the official documents in force before any decision, commitment or application. In case of discrepancy, the official document prevails.
- The sources cited by the Service are there to enable this check.
- Use of AI features may be subject to quotas.
9. Public data and third-party services
The Service displays public data (cadastre, planning documents, risks, base maps) produced by third parties, in particular IGN, and subject to their own licences. It relies on technical providers described in the Privacy Policy. The publisher does not guarantee the accuracy or availability of these sources and services, which are beyond its control.
10. Plans and payment
The Service includes a free plan (Discovery) and paid plans reserved for professionals, governed by the general terms of sale (CGV), accepted at each subscription. The CGV set out in particular prices, renewal, cancellation and refunds.
No payment will be requested without an express subscription on your part. Payments are processed by Stripe; Rotarchi has no access to your card details.
11. Intellectual property
The Service — software, interface, brand, editorial content and documentation — belongs to the publisher or its licensors and is protected by intellectual property law. The Terms grant you a personal, non-exclusive and non-transferable right of use for the life of your account, with no other transfer of rights.
12. Availability and changes to the Service
The publisher endeavours to keep the Service available at all times, without guaranteeing permanent availability: maintenance, updates or incidents may interrupt it. Features may change; a change that removes an essential feature will be announced in advance.
13. Term, account deletion and suspension
The Terms apply for an indefinite period, for as long as your account exists.
- You can delete your account at any time from Account > Data. It is then deactivated for 30 days, during which you can cancel, and then permanently deleted. You can also request immediate deletion.
- Before deleting your account, you can download your data from the same page.
- Projects in your personal workspace are deleted with your account; those of a shared organisation stay with that organisation.
- In case of serious breach of the Terms, the publisher may suspend or close your access, after notice except in urgent cases or where required by law.
What happens to your data when the account is closed is described in the Privacy Policy.
14. Liability
The Service is provided as is, without guarantee that it is error-free or uninterrupted, to the extent permitted by law. The publisher cannot be held liable for decisions made on the basis of Results that were not checked in accordance with section 8, nor for indirect damage.
Nothing in the Terms excludes or limits liability that cannot be excluded or limited by law, in particular for gross negligence, wilful misconduct or personal injury. If you are a consumer, these provisions do not deprive you of the rights you have under mandatory provisions of law.
If you use the Service for professional purposes, you will indemnify the publisher against any third-party claim resulting from a use of the Service contrary to the Terms or the law.
15. Personal data
The processing of your personal data is described in the Privacy Policy, which forms an integral part of these Terms.
16. Changes to the Terms
The Terms may change along with the Service or the regulations. Each version is numbered and dated. A new version is presented to you the next time you sign in and must be accepted to keep using the Service. If you refuse it, you can download your data and delete your account.
17. Governing law and disputes
The Terms are written in French, and the French version prevails over any translation. They are governed by French law.
In case of dispute, please contact the publisher first to seek an amicable solution. If no agreement is reached within thirty days, the dispute may be brought before the competent courts. No arbitration clause applies.
If you use the Service for professional purposes and no amicable solution is found, the dispute falls within the jurisdiction of the competent courts of the publisher's registered office, to the extent permitted by law.
If you are a consumer, you keep the protection of the mandatory provisions of the law of your country of residence and may bring proceedings before the courts designated by law, in particular those of your place of residence. You may also use the consumer mediator free of charge, after first trying to resolve the dispute directly with the publisher:
- Consumer mediator
- CM2C L612-1
18. General provisions
If any clause of the Terms is held invalid, the others remain in force. Failure to enforce a breach does not waive the right to enforce it later. The Terms, the Privacy Policy and, where applicable, the terms of sale constitute the entire agreement between you and the publisher regarding the Service.
19. Contact
For any question about the Terms, write to the contact address given in the legal notice.
